Returns and Exchanges
These Terms of Return and Exchange of Goods (hereinafter — the “Terms”) define the procedure and timeframes for returning goods purchased on the website myorganics.ru, and have been developed in accordance with the Civil Code of the Russian Federation, Russian Law No. 2300-1 of 07.02.1992 “On Protection of Consumer Rights” (hereinafter — the Russian Law “On Protection of Consumer Rights”) and Russian Government Decree No. 2463 of 31.12.2020.
The seller of the goods is OOO BRUSHGROUPP (BRUSHGROUPP LLC) (INN 1685006355, OGRN 1221600073012), address: Chapaevsky Pereulok 6, premises 2/1, Moscow, 125057, Russia.
1. General Provisions
- The sale of goods on the website myorganics.ru is carried out by remote means — on the basis of the buyer reviewing the description of the goods placed in the catalogue, without the possibility of directly examining the goods at the moment of concluding the contract (Article 26.1 of the Russian Law “On Protection of Consumer Rights”).
- The main subject of sale is perfumery and cosmetic products (hair and scalp care products).
- The buyer has the right to return or exchange goods under the conditions and within the timeframes established by these Terms and the applicable legislation of the Russian Federation.
- The provisions of this section do not limit the consumer rights expressly provided for by the Russian Law “On Protection of Consumer Rights”.
2. Return and Exchange of Goods of Adequate Quality
Perfumery and cosmetic goods of adequate quality are included in the List of non-food goods of adequate quality that are not subject to exchange (approved by Russian Government Decree No. 2463 of 31.12.2020). This means that cosmetics of adequate quality are not subject to exchange or return on the basis of Article 25 of the Russian Law “On Protection of Consumer Rights”.
In the case of a remote (online) method of sale, the buyer has the right to refuse the goods (Article 26.1 of the Russian Law “On Protection of Consumer Rights”):
- at any time before its delivery (before the moment the order is received);
- within 7 days after the goods have been delivered.
At the same time, with respect to perfumery and cosmetic products, the exercise of the right of refusal is limited by the nature of the goods. The return of cosmetics of adequate quality is possible only if all of the following conditions are simultaneously met:
- the marketable appearance and consumer properties of the goods have been preserved;
- the factory packaging has not been opened, and the protective film and the factory (control) integrity seal have not been broken;
- the goods have not been used and there are no signs of use;
- all of the manufacturer’s tags, labels and seals have been preserved;
- there is a document confirming the fact and the conditions of the purchase of the goods.
For the purposes of sanitary and hygienic safety, cosmetic products with opened packaging, a broken protective seal or signs of use are not subject to return or exchange, since the marketable appearance and consumer properties of such goods have not been preserved.
If information on the procedure and timeframes for returning goods of adequate quality was not provided in written form at the moment of delivery, the period for refusing the goods is 3 months from the moment the goods were delivered.
3. Return of Goods of Inadequate Quality
The above restrictions do not apply to goods of inadequate quality. If the buyer has been delivered goods with defects (faults, defects, expired shelf life, breach of integrity, non-conformity with the declared characteristics), they have the right, at their own discretion, to demand (Article 18, Article 26.1 of the Russian Law “On Protection of Consumer Rights”):
- replacement with goods of the same brand (model, article number) or with the same type of goods of another brand with a corresponding recalculation of the price;
- a proportionate reduction of the purchase price;
- free elimination of the defects of the goods or reimbursement of the costs of correcting them;
- withdrawal from the contract and a refund of the amount of money paid for the goods.
The buyer also has the right to demand full compensation for losses caused as a result of the sale of goods of inadequate quality.
Claims regarding defects of the goods may be submitted within the shelf life of the goods, and if no such period has been established — within two years from the day the goods were delivered to the buyer.
Delivery of large-sized goods and goods weighing more than 5 kg for replacement, return, repair or price reduction is carried out by and at the expense of the Seller.
4. Refund Timeframes
- If the buyer refuses goods of adequate quality, the Seller refunds the amount paid (less the costs of delivering the returned goods) no later than 10 days from the day the corresponding demand is made (Article 26.1 of the Russian Law “On Protection of Consumer Rights”).
- When returning goods of inadequate quality, the demand for a refund of the amount paid is satisfied within 10 days from the day the demand is made (Article 22 of the Russian Law “On Protection of Consumer Rights”).
- The refund is made by the same method by which the payment was made (to the same bank card or account), unless otherwise agreed by the parties.
- The time for crediting the funds to the buyer’s account depends on the rules of the issuing bank and the settlement organisation.
5. Procedure for Filing a Return
To arrange a return or exchange of goods, the buyer must:
- send a request in free form to the email address support@myorganics.ru or by telephone at +7 985 875-88-82;
- indicate in the request: the buyer’s surname, first name and patronymic, the order number and date, the name of the goods being returned, the reason for the return, as well as contact details and bank details for the refund;
- attach a document confirming the fact and the conditions of the purchase (a cash receipt, an electronic receipt, the order number); the absence of such a document does not deprive the buyer of the possibility of relying on other evidence of the purchase;
- for goods of inadequate quality — if possible, attach photographs confirming the presence of the defect.
After the return has been agreed, the Seller informs the buyer of the address and method for returning the goods. The returned goods must be handed over in the configuration in which they were received.
The Seller has the right to carry out a quality check of the goods and, if necessary, an independent examination to establish the causes of the defects, in the manner provided for by the Russian Law “On Protection of Consumer Rights”.
6. Return Costs
- When returning goods of adequate quality, the costs of the return shipment (delivery) of the goods are borne by the buyer.
- When returning goods of inadequate quality, all costs related to the return, replacement or elimination of the defects of the goods are borne by the Seller.
